Read this one bit if nothing else. Swipe Gallery deletes photos and videos from your device when you tell it to. Deletion is real. Check what you are binning before you confirm, and keep a backup of anything you would be upset to lose.
1. Agreement
These terms are an agreement between you and Atyuttama Enterprises LLP ("we", "us") covering your use of the Swipe Gallery mobile application ("the app"). By installing or using the app you accept them. If you do not accept them, please do not use the app.
Your use of the app is also subject to Apple's App Store Terms of Service, and to our Privacy Policy.
2. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own use. This licence does not transfer ownership of anything to you.
3. Deletion and your responsibility
The purpose of the app is to help you remove photos and videos from your device. That makes deletion its core function, and the consequences of it are yours.
- The app never deletes anything on its own. Swiping marks items; removal happens only when you confirm, and iOS shows its own confirmation as well.
- Deleted items go to Recently Deleted in the Photos app, where iOS normally keeps them for about 30 days. After that they are gone permanently.
- We never hold a copy of your photos or videos, so we cannot recover anything for you at any point.
- You are responsible for reviewing what you have marked before confirming, and for keeping your own backups of anything important.
4. Accuracy of what the app finds
Duplicate detection, blur detection and storage figures are produced automatically and are offered as suggestions, not verdicts. Blur detection in particular is a measurement of sharpness, and it can flag a photo that is deliberately soft or artistic, or miss one that you would call blurry. Storage figures may differ slightly from what iOS reports, because the operating system counts some things differently.
Always rely on your own judgement of the photo in front of you rather than the category it has been sorted into.
5. Acceptable use
You agree not to:
- use the app to access, organise or delete content on a device you do not own or have permission to use;
- use the app to handle material you do not have the right to possess;
- reverse engineer, decompile or attempt to derive the source code of the app, except where that restriction is prohibited by law;
- copy, resell, sublicense or redistribute the app.
6. Ownership
The app, its name, design, artwork and code remain our property and that of our licensors, and are protected by intellectual property law. Your photos, videos and files remain entirely yours — we claim no rights whatsoever over your content, and never receive it.
7. Availability and updates
We may update the app to fix problems, improve it or add features, and we may change or discontinue it. Updates are distributed through the App Store and your device's settings control whether they install automatically. We do not promise that any particular feature will remain available indefinitely.
8. No warranty
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that its results will meet your expectations.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits any rights you have as a consumer that cannot lawfully be limited.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data, photos, videos or files, arising out of or connected to your use of the app — including deletions you carry out with it.
Where liability cannot be excluded, our total liability to you is limited to the amount you paid for the app in the twelve months before the claim, or the minimum amount permitted by law, whichever is greater.
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
10. Termination
You may end this agreement at any time by deleting the app from your devices. The licence in section 2 ends if you breach these terms. Sections 6 and 8 to 11 survive the end of this agreement.
11. Governing law
These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute arising from them. If you use the app as a consumer elsewhere, you keep the benefit of any mandatory consumer protections of the country where you live.
